A pending New York legislation would create a $4 billion fund for the families of those who have died after contracting COVID-19 in a nursing home. In March of 2020, an order prohibited nursing homes from denying placement of COVID-19 positive patients. The order also banned nursing homes from testing residents for the deadly virus. Even after the order was repealed in May of 2020, independent reports have shown it to have resulted in "possibly more than 1,000 deaths".
In New York alone, over 15,000 residents of nursing homes have died of Covid since March of 2020, but a provision in the Emergency or Disaster Treatment Protection Act granted nursing homes and their workers immunity from negligence lawsuits. Only after backlash from lawmakers, and victim's families was the act repealed.
